BETWEEN:

DALHOUSIE STAFF ASSOCIATION (hereinafter known as the "DSA")

OF THE FIRST PART

- and -

NOVA SCOTIA GOVERNMENT EMPLOYEES UNION (hereinafter known as "NSGEU")

OF THE SECOND PART

AGREEMENT

WHEREAS the DSA and the NSGEU have been parties to an Affiliation Agreement effective the 1st day of July, 1992;

AND WHEREAS the membership of the DSA has, in accordance with the DSA Constitution, decided to transfer its jurisidiction to, merge and emalgamate with the NSGEU;

AND WHEREAS the Board of Directors of the NSGEU has ratified the inclusion of the DSA as a local of the NSGEU pursuant to the terms agreed to between the parties,

THEREFORE IT IS AGREED AS FOLLOWS:

1. Effective the date of a successor rights order from the Nova Scotia Labour Relations Boards, the DSA shall become a full local of the NSGEU with al the rights, priveleges and obligations thereof. These include:

  1. Under the present Constitution, the DSA is entilited to its own Board Member on the Union's Executive Board.
  2. Full access to the Strike Fund.
  3. Full servicing and carriage of grievances.
  4. Administrative support for committees, newsletter production and other like services.
  5. Membership access to union education programs.

2. The Constitution of the Dalhousie Staff Association will become its local by-laws and must be consistent with the NSGEU Constitution and by-laws.

3. Membership dues in the amount of 1.25% shall be collected by the local union, but shall be the property of NSGEU. Any surcharge in excess of 1.25% shall remain with the local. NSGEU dues may be amended from time to time in accor dance with the NSGEU Constitution.

4. The local shall be provided with an imprest account from which operating expenses may be apid. This account is currently in the amount of $400. But us suject to change by the NSGEU. It shall be replenished as necessary.

5. The DSA shall continue to be responsible for all its outstanding accounts, charges, salaries and other debts as of July 1, 1992, the effective date of the affiliation agreement between the parties. The NSGEU shall be responsible for all debts, accounts, charges and salaries of the DSA accrued after July 1, 1992.

6. The contingency fund assets and currently held office equipment shall continue to be the property of the Dalhousie Staff Association Local. The DSA will do an inventory of office equipment which is the property of the DSA at the time of the signing of the affiliation agreement. All other equipment is deemed to be the property of the NSGEU.

7. The NSGEU agrees to honour the terms of the current collective agreement between the Dalhousie Staff Associaiton and the Dalhousie Staff Association Staff Union. The current Executive Director and Office Administratot will become employees of the NSGEU and will be included in the LASSOEU bargaining unit. The following has been agreed to with respect to these employees.

  1. Don Larder will be classified as an ERO II (servicing and negotiating) and will be paid at Step 2 in accordance with the current LASSOEU collective agreement.
  2. Tina Webber will be classified as a Secretary under the LASSOEU collective agreement, but will have her present salary "PIO'd" at the present level, including the pay adjustment which was due to that position in May of 1993.
  3. Neither Don Larder nor Tina Webber will be required to serve any probationary or assessment periods as outlined in the LASSOEU/NSGEU collective agreement.
  4. (i) Don Larder will be given recognition for service from his initial membership in an NSGEU local.

    (ii) Tina Webber will be given recognition for service from February 1989.
  5. Don Larder will be given recognition for seniority from December 7, 1992 forward. Tina Webber will be given recognition for seniority back to July 1, 1992, the effective date of the Affiliation Agreement.
  6. The tuition benefits for Don Larder (one full credit university course) and Tina Webber (two full credit university courses) will be continued while these individuals are employed by NSGEU.
  7. There will be an adjustment of the job duties of Tina Webber, to ensure that they are consistent with the secretarial classification into which she is being placed.

8. The NSGEU intends to maintain a staffed office presence at or near Dalhousie University and will continue to provide the Dalhousie Staff Association Local with all support necessary to maintain the level of services to DSA members in existence at the time of signing of this agreement.

9. The Dalhousie Staff Association shall continue to be fully responsible for the cost of processing all grievances referred to arbitration prior to the July 1, 1992 affiliation agreement. This includes all grievances pursuant to the collective agreement, any labour board applications to which the DSA is a party as an applicant or respondent and any other legal actions to which the DSA is a party.

10. All grievances filed following July 1, 1992 shall be the full responsibility of NSGEU. This includes all grievances pursuant to the collective agreement, any labour board applications to which the DSA is a party as an applicant or respondent and any other legal actions to which the DSA is a party. The NSGEU shall consult with the local executive regarding the disposition of all such matters.

11. Any other rights of the Dalhousie University Staff Assocation Local shall be determined by the Union Constitution and by policy as set by the membership at the Union's biennial convention. The Dalhousie University Staff Associat ion Local shall have delegate representation at the Union conventions.
